For many farm and ranch families, bringing the next generation into the operation is a key goal. Achieving this transition successfully requires strategic financial planning, ensuring both generations maintain financial stability.

A gift leaseback strategy is an approach that allows asset transfer while preserving operational access. In this model, a donor, typically a parent, gifts farmland or equipment to a donor, usually a child or grandchild. The donor leases the asset back to the donor at fair market value, allowing them to continue using it.

This arrangement benefits the donor in several ways:

  • Continued access to the asset for farming or ranching.
  • Estate tax reduction by removing the assets from the estate.
  • Potential long-term care benefits by decreasing taxable assets.
  • Lower property taxes depending on asset classification.
  • Income tax deductions from lease payments are classified as business expenses.

The donor also gains advantages:

  • Receives an asset as a gift.
  • Earns rental income from the lease agreement.
  • May depreciate the asset if applicable.
  • Has flexibility to modify or terminate the lease if needed.

Beyond land, machinery and equipment can also be transferred using this method. However, it is crucial to ensure compliance with IRS regulations. A formal written lease agreement must be in place, and lease terms must be followed to avoid legal issues.
